Bids made at a sheriff’s sale are assumed to have been given freely by individuals with an understanding of all necessary information. The Sheriff’s Office cannot give legal advice. Any legal questions should be referred to an attorney. Assessing the accuracy of Sheriff’s Sale information is the responsibility of the bidder. The sheriff’s office is selling the property as described by the legal description. The numerical street address is provided only as a courtesy.
The only information the sheriff’s office has regarding properties is provided in the Notice of Sheriff’s Levy & Sale. Notices of Sheriff’s Levy and Sale are posted in four public places in Council Bluffs: Pottawattamie County Courthouse (227 S. 6th St.), Council Bluffs Public Library (400 Willow Ave.), Pottawattamie County Sheriff’s Office (1400 Big Lake Rd.), and Council Bluffs City Hall (209 Pearl St.).
Properties located in the western half of the county have their Notices of Sheriff’s Levy and Sale published only in the Daily Nonpareil. Properties located in the eastern half of the county have their Notices of Levy and Sale published in both the Daily Nonpareil and the Avoca Journal Herald. Publications are scheduled for four and five weeks before the originally scheduled sale date.
The Judgment amount listed on the Notice of Sheriff’s Levy & Sale does not contain all the costs due at the time of sale and is not a reflection of what the opening bid amount might be.
Any person wishing to bid at a sheriff’s sale must be pre-registered. Bidder Registration Forms are available at the Pottawattamie County Sheriff’s Office and must be completed before 10:00 am on the date of the sale. A new Bidder Registration Form must be completed on each sale date.
Sheriff’s Sales are open to the public and start at 10:00 AM at the Pottawattamie County Sheriff’s Office. The mortgage company will provide an opening bid. The sales are conducted as a public auction. Should no one bid on a specific property, it will go to the plaintiff or their designee.
To purchase a property, a person must be the highest bidder by at least $1.00 over the next highest bid. Bids made at a sheriff’s sale create a legal obligation to pay. Failure to follow through on a bid may result in legal action and being prohibited from bidding at future sales. If the highest bidder fails to pay, the next highest bidder will be notified and will have two hours from the time of notification to purchase the property for their highest recorded bid.
There are NO refunds.
Payment is due within two hours of the closing of the sale. The only checks that will be accepted are cashier’s checks, and they need to be made out to the Pottawattamie County Sheriff’s Office. It is the responsibility of the bidder to have their finances set up to accomplish this before bidding. Once payment is received, paperwork will be completed as soon as the sheriff’s office workload permits. The purchaser then assumes all responsibility for the paperwork.
Some sales have a redemption period. In such cases, a certificate of purchase will be issued to the purchaser. At the end of the redemption period, if the property was not redeemed, the deed can be issued after the purchaser returns the original copy of the certificate of purchase to the sheriff’s office. Questions regarding a purchaser’s rights during the redemption period should be referred to an attorney.
