Garnishments

  • The Sheriff's Office will need a Dictation to Sheriff filled out which is directions as to how you want your judgment collected: garnishment of wages, demand, levy/sale, any identifiers for bank accounts, addresses, place of employment, etc. A printable copy of the Dictation to Sheriff is available on this website.
  • Actual fees for service for a garnishment are added to the amount of the judgment to be garnished. If enough funds are collected from the garnishee you will be refunded your service fees.
  •  If you have the Sheriff garnish a bank, most banks require (besides the defendant's name) other identifiers such as a social security number or an account number. If you do not have an identifier, the Sheriff will serve the garnishment, but your chances of receiving any funds on the garnishment are reduced.
  • In Iowa, garnishments expire in 120 days. After expiration the execution will be returned to the appropriate Clerk of Court with any funds collected. Federal and State laws determine the maximum amount, if any, which can be garnished from a defendant's paycheck and annually.
  • If the execution expires and full judgment amount is not collected, you may request from the Clerk of Court a new execution to be sent to the Sheriff along with Dictation and fees to continue collecting funds to pay off the judgment.
